I would like that my husband not be a beneficiary when drafting my will and last testament. At present we do live together and have been married for 18 years. My mom mentioned that as my spouse he is entitled to part of my estate. I have 2 kids that are adults. I would like that they be the only beneficiaries. You can omit your spouse. It is not illegal. However, an omitted spouse can elect to receive a surviving spouse share in every state that I am familiar with.
