My 92 year old mother (in New Jersey) is leaving her house to her 4 children to be sold upon her death. One brother, who also lives in New Jersey with her, owes a considerable amount of back taxes (wage taxes) in another state. My question is can a neighboring state put a lien on the property to collect on the back taxes once it is known he is beneficiary to the proceeds? If so, would it be on the entire estate or just what would be considered his share? Also this same brother has threatened to override her wishes and remain in the home and prevent any sale of the property...can he get away with that?

There is only an expectancy now, not A RIGHT. wHEN mOM DIES, if SHE LEAVES ANYTHING TO bROTHER, then a lien can be placed on BROTHER'S rights.

Careful estate planning can enable mother to leave something to the brother, not the tax collector.
