i reside in florida. please tell me what the phrase "equally, per capita, as and for their INDIVIDUAL ABSOLUTE PROPERTY FOREVER" means. two people were named in a will, and one of them is now deceased. does that half go to the other person named in the will or does that half go to the heirs of that second beneficiary? thanks for the definition and the help.

It depends on what else the Will says. Generally under most states' laws if a named beneficiary dies, and the Will does not specify that his heirs receive with langauge such as "or if he shall not survive me, his heirs" the legacy lapses. But I am not a Florida lawyer.
