Distributing the estate


What is the name of your state? KY

My great-grandmother died in Feb 03. We all thought she was leaving the estate to my uncle and my mother. However, when the will was read, she also included my brother and I...all equals...25%. We are all adults but my uncle has a 1 year old at time of death and very very furious that his daughter was not in the will but we were.

He is gonna try and add his daughter to the will but hasn't filed anything. How can he be the executor and try and add a beneficiary at the same time? Isn't there a conflit of interest there?

The estate funds ($130K) is ready to be dispursed. The money is just sitting in the bank but my uncle won't dispurse out of anger. Can he hold the estate up even though he hasn't filed anything?

We do have a lawyer on the 3 of our behalves to protect our 25% interest. We just filed a motion in court to force my uncle to distribute the funds and to get him thrown off as the executor as well if that does not go in our favor. He gave his father a key to the house that was sold to fix some walls and do a little painting. The problem is that his father stole about $2000 worth of property(antiques, complete bedroom funiture, washer, etc) from the house and gave some it away to his "renters" for free. Isn't this grounds for removal?
