What is the name of your state? Massachusetts

My mom recently passed away leaving my brother and I as heirs. She had 2 main asstes, her home & stock. Mine, my brothers, and my moms names were all on the home & stock. Do we need a lawyer to go through probate or since our names are already on it can we just split things up in accordance with the will?

**A: Concerning the real property and the stocks, how was title held; ie. T/C or J/T? Probate is needed.
