Durable Power of Attorney in Tenness

i need to know if in tennessee my 89 year old mother needs to be declared incompetent before the durable power of attorney kicks in. mother named the person who she wanted to have durable power of attorney when she lived in kentucky and there it kicks in when the she can no longer make decisions for her own well being.

It depends if it is a SPRINGING durable power or not. And a lawyer would have to see it to say.
