of an estate dies - and you need to nominate a
new executor since the estate assets have not
been completely distributed.

DEAR DHDEAVER:

It would be preferable for an attorney (who is familiar with Texas laws) to be nominated (by the family of the deceased--they get to pick the replacement executor) to be the new executor, but if the estate can not afford the attorney fees for this, then another family member, if they wish, could file the paperwork at the probate court to be executor.
