Looking for a little advice due to bad advice from estate's lawyer.

My wife's father passed away(2005)and here are our issues.

1. Farther in law's will left everything to daughter and stepmom of 7 years has renounced the will to get her 1/3 of estate under IL law.

House was bought in 1993 by FIL and deeded in J/T with then girlfriend(now stepmom). He made all mortgage payments (automatic payments from individual account) and his name alone is on mortgage docs. There is a balance left on the mortgage. Doe's the daughter have any recourse available to her to take partial possesion of the house? If not, is the house considered part of the overall value of estate?
