What is the name of your state (only U.S. law)? NC
My father left a marital/children's trust in 1983. My mother passed away recently and I have 3 siblings. There is real property and money left in the trust and states that it will be divided equally among the siblings. One of my siblings is requesting to move into the homeplace. The other 2 siblings do not want any money but I do not feel like this is the appropriate way to handle this situation. I believe this could become legal nightmare between us in the future. There are things unseen that I believe we should be wary of.

Do all assets have to be disbursed within a certain amount of time within a trust in NC?

Can one sibling move into the homeplace without paying out the others if so what could be the pitfalls?

What other advice or questions do you have?
