What is the fee to probate a will in California? Is there a state mandated percentage or is each attorney able to charge a negotiated fee? If there is a mandated percentage, what is it? If not, what is generally charged?

DEAR SV:

Please explain more specifically what you mean--there is a difference in the "court filing fee" to submit a will for the probate process, or did you mean what will be the "executor fee" to handle the entire probate process from the time the estate is open until the time it is closed?

EXECUTOR FEES IN CALIFORNIA:

4% of the first $15,000., plus
3% of the next $85,000., plus
2.5% of the next $900,000.

If the executor of an estate is not an attorney and seeks legal assistance after a will has been admitted for probate, is the fee statutory or is it the attorney's normal hourly rate?
