What is the name of your state? Il. (sorry I put this in the wrong forum the first time.) Husband and I have been married for 15 yrs. He has 2 children in their 20's; I have one in his 30's. We have very little, (small svgs. act. and both of our pensions, and husband's life ins. with me as beneficiary.) Vehicles are old. Home about to be sold, and we will live in mob. home in Fl. If he should predecease me, do his children have a right to contest a will leaving me "everything"? Thank you.

A: Anyone can sue anybody for anything anywhere at any time. Whether they win is another question.

The things in your favor are the length of the marriage and the length of time the will has been written. (And, of course, the smallness of the potential estate.)

Make certain to have an estate attorney draft the will so that the children are named but it is clearly stated that the assets go to the surviving spouse. Perhaps the wills could specifically leave some personal item to each child. Spouses do have the right to leave their estate to each other, you just need to be certain the wills are properly set up so that they are LEGALLY valid in the event of a challenge.
