What is the name of your state (only U.S. law)? MO

my boyfriend and i arent married but we have one child togeather and another on the way, we want both of the children to go to my sister should anything happen to us, along with everything we own. can we do a will in both of our names naming her the guardian or would we have to do it seperatly?

You can both name her as standby guardian, yes, and you'd be far better advised doing this with an attorney.

You can't "will" your children like you can property; generally placement would be with the legal next of kin (usually your parents - either set, provided Dad is legally established as Dad) first but that standby guardianship may well come in handy. It can absolutely increase the odds that your wishes are granted.

Please, speak with an attorney. And kudos for thinking of what "may" happen :)

(if only every parent would do so!)
