help preparing willWhat is the name of your state? Indiana I have been married to my husband for 7 years. He has a 13 yr old daughter which lives with us and together we have a young son. Due to extreme differences in my husband and my views on noney management, we have decided to have seperate finances for several years. We have filed seperate taxes and have seperate banking accounts. Also, the house is is my name only. We have no property or money jointly listed. (I know it sounds strange, but it works for us) Anyway, obviously I would want my home to go to my husband and my son in the event of my death. I do have him listed as beneficiary to my life ins. If I would die prior to making a will, would my husband automatically get my house because he is my surviving spouse? Also, I have left a portion of my life insurance to my mother to set aside in a trust for my son's education. Is it possible to stipulate in the will that in the event my son does not seek education post high school that he not have access to the money until he is of a certain age? I would not want my son to get several thousand dollars at the age of 18 and blow it. FInally, is there a way for my husband and myself to make out a will with the above issues mentioned without the use of an attorney? Thank you in advance for your help. |

| IF I WOULD DIE PRIOR TO MAKING A WILL, WOULD MY HUSBAND AUTOMATICALLY GET MY HOUSE BECAUSE HE IS MY SURVIVING SPOUSE? He would get ½ of your estate. Your son would get the other half. ALSO, I HAVE LEFT A PORTION OF MY LIFE INSURANCE TO MY MOTHER TO SET ASIDE IN A TRUST FOR MY SON'S EDUCATION. If this money is to go to an educational trust, the stipulation you want should be put into the trust, not your will. IS THERE A WAY FOR MY HUSBAND AND MYSELF TO MAKE OUT A WILL WITH THE ABOVE ISSUES MENTIONED WITHOUT THE USE OF AN ATTORNEY Maybe. First of all, there are books on doing your own will. You could look at one or two of them and see if you feel comfortable with it.
