i need to know if an executor agrees that a piece of property should go to an heir, though not named in the will, but the probate attorney says property must be sold and the proceeds added to the estate.....can the executor claim the property to be sold to an heir at below market value??????

DEAR CHZ:

How much is the property actually worth?

How much does the executor want to sell it to the heir for?

Who are you or how are you involved in this transaction: are you the heir who is going to buy the property or a beneficiary of the will who will benefit from the proceeds of the sale?

You will eventually have to consult with a local probate attorney or real estate attorney about this matter, since it might be possible that the executor could sell the property for $1 (if they wanted to do that, though that is somewhat unlikely), if the estate owns the property. Somehow I feel the executor will sell for a higher, more reasonable value.

SINCERELY,

advisor
