What is the name of your state (only U.S. law)? GA
In my divorce the home was deeded to me (wife). I continue to stay in the home and make the mortgage payments. The home was Quit Claim deeded to me. On the original loan my ex was removed as owner because the home was deeded to me but he was left as co-signer. In the divorce papers it states that I am to draw up a Will that the home will go to him should I still own the home at the time of my death. My question is: Can I deed my home or give as a gift to my brother or someone else with or without the mortgage to void this clause that states my home goes to him at the time of my death?
