My father passed away almost a year ago. Everything has been distributed except for the sale of the house. One brother is executer and has handled things pretty well except he is allowing my other brother to live in the house rent free. He moved in six months before dad passed (on the day of mom's funeral). The house is supposed to be sold and the funds distributed. We can't get my brother to move out so we can clean and fix things up. (he lives like a pig) He has also said the estate owes him for the money he has spent on utilities and heat.
Is there a way to make him pay rent (present and past) to the rest of us? We are worried he will damage the house and the we will have to pay for the repairs.
