Texas: Background: My mother had 5 natural children -- three from a former marriage and two with second husband.

During their marriage, her second husband inherited 30 acres - which in Texas was his separate property. However, upon his death, his Will left everything to my mother.

My mother has since died and according to her Will - she left her estate to be divided equally among her five natural children.

Question: Is the 30 acres to be divided amongst all five children or only divided between the two natural children she had with her second husband?

My response:

When H2 died, mother became the owner of all the land, becoming part of her Estate. Since it was hers alone, she could do with it as she pleased and, in this instance, she did just that - - she wanted her estate to be divided equally among her five natural children.

Simple. End of story.
