My lawyer died and his partner closed the office. The building is now up for sale. My hubby and I had our wills drawn up by him and they were kept in his office for safekeeping. He advised us not to file them with probate court. We have copies but his office has the originals. Phone calls only get an answering machine and the calls are never returned. Don't know what to do? Do we have to see a new attorney and make new wills or is there a way to obtain the ones that the deceased attorney had in his possession. We live in Michigan.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

I think you can rexecute the copies if they were original copies and signed.

If not, retype the copies and execute them with witnesses and a new attorney.

But if you DO want your files back (I would to) how about trying to go through your Michigan State Bar Association and see what protocal they suggest.

Go to the county bar association and ask for their help. Most will solve the problem for you.
