What is the name of your state?

Hello :

My aunt gave me her property 6 years ago with an life estate clause . She also gve me the financial and health POA . She has been in a nursing home for almost one year now and requiers 24 hour care and is incompatant so she will never be able to return home . My question is can i remove the life estate .

Nope. And you can't sell the place either. You have the right to live there as long as you live. But you will never own it unless your aunt's will grants you that right.

Ummm. Did she deed you the RE and reserve the life estate for herself, or the reverse?

i read this as the RE to you, with the life estate for her.

Which would mean you do own the RE, subject to aunt's life estate.

I didnt explain very well but she has the life estate. And the property is allready deeded to me .
