What is the name of your state (only U.S. law)? California
my parents is setting up a living trust to protect their home from estate recovery. I was told a living trust will avoid probate, would it also protect them from estate recovery? Also if there are outstanding liens such as mortgages and promissory notes, would they be paid first before estate recovery? Thanks for your help in advance.

I believe a IRREVOCABLE trust can be used to dodge medi-cal recovery of certain assets (like the residence). This isn't really a do-it-yourself thing. You need a lawyer who is versed in these things. And while your at it, do everybody involved a favor and set up the advance medical directives and medical power of attorney (usually the same lawyer does all of these).
