What is the name of your state? Nevada. My husband has a piece of property that is in a testamentary trust in which he is the beneficiary of and I am the trustee. We are in the process of getting a loan on the property so that we can fix it up and sell it. The title company is saying that unless we go to the Judge and have the trust removed they cannot give us clear title to close escrow. Here we are about to close and have hit a brick wall. Please help! We thought that I being the trustee could give the ok? Can something just be filed with the county?
