My mother passed away in August after an extended illness. My father and I had served as caregivers. I am an only child and my parents did not have a will at the time of my mother's death. I accompanied my father to an attorney's office shortly after her death. My dad explained that his wife had passed away and that he needed to know what to do to settle her estate. The lawyer asked questions about assetts, etc. He said that at a certain point in the process I would have to come in and sign some papers releasing my share of the estate. This was never done yet my dad has received documents stating that the estate has been settled. My dad also had the lawyer draw up a will stating that all of his assetts and property were to go to me upon his death. My father has since met a woman who he is going to buy a home with. He is selling the family home and most of the furnishings and is planning on taking the money to pay as a down-payment on a home for him and his new girlfriend. In the meantime, his family is cleaning the house out taking almost all of the furniture. My question is: since my mother passed away without a will, am I entitled to a share of the estate? I am pretty sure that the new home will be in both of their names and I am also pretty sure that my dad will be changing his beneficiaries, etc. since they will have joint debts and assetts. My fear is that he will change his will and everything and I will end up with nothing from my mom's estate. Is there some provision for me to collect my share now? What happens if my dad does not change his beneficiaries or will? Would I be entitled to his share of the new home upon his death? What happens if he remarries? She has children of her own. Any advice or help would be greatly appreciated. I know nothing about law and this is a very messy situation. Thanks.
