Parents had estate planned to sell and divide for 3 kids.
Dad died 1996, oldest kid "took" executorship, then took 90K out of the estate in cash to purchase a house in cash in his name only. Signed note stating that he owed the estate 60K for both the other 2 kids. Mom died 1997, oldest kid was still executor. he got remarried summer of 1998 and died Oct. 1998 without having paid back the 60K. The new wifeypoo and his finances were comingled and court has asked for her/his financial records. Court was last Dec she asked for extension and of course got it to May 15 to produce records. May came and went she has produced nothing and no money. she claims estate owes her 58K. There is one more house out of the estate that just sold last fall, assets frozen and money is just sitting there until the wifeypoo decides to cough up info. Why is the court allowing this? There is a new date set for aug 3. We just do not understand what the hell is going on and why the court is even allowing the lawyer to keep dragging his feet with his client (the wifeypoo). What to do to get this 60K outta her?
