Divorced father left no will and only property is money in bank account, app. 1,000 dollars . no other names on account , banks only reply was see a lawer wich i can`t afford after costs of burrial , no insurance, Does bank keep the money?

DEAR STANJG:

Is your father's wife still living? Is she going to be the administrator of his estate, or would you prefer to be the person that does that?

Your father should at least have named someone on the bank account signature card to be his beneficiary, but since he didn't do this, the administrator of his estate can claim this money. You can go to the probate court at the county courthouse to file papers to become the administrator, and you will soon receive from the court the legal papers that authorize you to start claiming your dad's assets. Just present the administrator papers to the bank and they will release the money to you.

But you must pay any outstanding debts of your father's from this money before you get to keep what is left over, and you will be required to account for how you spend it.
