My father suddenly died in Florida. No will can be found. He is survived by his second wife (married 10 yrs), my sister (age 42) and me (son,age 41). My step mother proposes that she and I be co-personal representatives. My sister and I wish that I be the single personal representative per my Dads past verbal statements and wish. The majority of the estate is left to my sister and me through beneficiary assignment of IRA's etc.. I have learned since his death that the marriage was not on solid ground with a possibility of divorce. What is the best strategy for me to be appointed the sole personal representative and represent my fathers estate? Who has priority, suviving spouse or children that represent 2 of the 3 heirs?
