If the living trust is funded correctly it avoids the need for probate.
Especially if you own property in two or more states, living trusts are advisable. With a will, you must probate the will in each state in which the decedent has property (one main probate proceeding and ancillary probate proceedings in each additional state). The living trust avoids probate altogether.
Using the living trust, it is possible to avoid court costs and future attorneys fees related to the probate proceedings. Be sure the property gets transferred into the trust however.
Living trusts are tax neutral insofar as no tax savings are lossed or gained. |
