my husband father died four years ago. his stepmother said there was a will. now four years later she is contacting the deceaseds children to sign off on a real estate transaction. what are thier rights. she claims she threw away the will and the lawyer claims he did not make a will. no will was probabted. what can we do to make her probabte the estate and give the nine childern their inheritance. part of the land is in their name jointly but the land with the home and improvements is in his name 100% and purchased before their marriage. also on the real estate transaction she is claiming the majority is hers under the tennat laws of pa. what forms are need to make her account for his estate and probate. do we need a lawyer.
