Petition for trustee

What is the name of your state (only U.S. law)? CALIF.
What should the Executor of an Estate tell the court when he finds out that an attorney filed a petition to appoint a trustee to a trust, but doesn't inform the court that the decedent left a will, and the beneficiary's of that will don't need a trustee to see ongoing litigation continue.??

Having a trust AND a will are common and can/do have separate functions. It is very beneficial for a trust to have a trustee.
