What is the name of your state (only U.S. law)? New York

All of my Father's assets are in a Trust. I have POA. My Mother (deceased) has a Residuary Trust after her death. I am the Trustee. All proceeds from both Trusts are to be divided between my Brother & I. I am the executor of my Dad's estate. He recently passed away. Can I simply divide all the assets between my brother & myself from both trusts?

i dont see wny not. that is what the trust language wanted, from what you indicated.

you probably realize, but the poa means nothing after death.
