The estate lawyer we used for my fathers estate, is now also the estate lawyer being used by the 2nd mortgage holder on our home. We are in dispute over several issues regarding this mortage now. Since the lawyer was also the lawyer for my fathers estate and has personal knowledge of what happened there. Wouldn't this be considered conflict of interest since she has personal knowledge of my financial situtation (although minor - only what was included in the estate) and now she is representing another person attempting to collect additional money?

Sounds like it, but conflicts are sometimes less than clear.

Contact the local bar discliplinary committee for advice. Actually, if you have a lawyer representing you now send her a letter, my sense is she'll back off.
