My mother passed away 2 months ago and named me as the sole beneficiary in her will. I am also the
executor. In her will she bequested $10,000 to a nephew. Legally, can I wait until the will
is probated to pay the nephew? Because of the apathetic relationship he had with her, I am
reluctant to transmit this money to him. What happens if I refuse?

You should file the Will for probate NOW and when it is admitted and you and your counsel are absolutely sure there are no claims against the estate and ready to make distributions, send the ingrate a check for $10k in exchange for a release.
