I talked to a lawyer on the phone. He said that we shouldn't have any problems with my hanicapped brother. Can you tell me if we can avoid probate court since the three of us agree on everything.

I don't follow. If you now have consulted a lawyer, and have gotten advice from the lawyer, why ask anyone else? Let that lawyer work it out for you. If on the other hand you pestered a lawyer and he gave an off the top of the head answer, that's not advice.
