my mother lives in georgia. i want to know if jointly owned bank accounts, cd's, cars, etc. go into probate at her death. If not, would this negate the need for mom to have a living trust as everything she owns is in my name, my brothers name & my mom's name. thank you!

DEAR DGD:

Jointly owned assets go directly to the named beneficiaries and do not need to be reported in the probate process. However, she still needs to have a will and if she desires a trust for protection you should still consult with a local attorney to find out the option that would best suit her needs and at the same time protect the interests of the heirs.
