my mother died last year-i was joint on the propertyand the only child. i have 6 children and want them to have this when i pass-- i'm also married the second time -- what is the law concerning my spouse in this?

Have a Will or Living Trust leaving the proerty to the kids. Your husband may have some rights to claim a portion of your estate, depending on the state of residence, but a lawyer who prepares the documents can also prepare a form that works a waiver of his rights if he agrees to sign it; but again, depending on the state it may not be needed.
