Renting a house with no name on deed

What is the name of your state (only U.S. law)? IN NEW YORK

We signed a lease with a man whose Mom passed away, she was the only person on the deed (not a transfer deed)....can he legally rent the house to us before his name is put on the deed? If not, are we obligated to keep the lease in force or can we leave and live somewhere
else if we want to....would that lease he signed be "null & void"?

There is no will ... the son is currently going thru the procedure of getting his name on the deed, but he signed the lease months ago.
