What is the name of your state (only U.S. law)? Tennessee, I would like to know about right of succession for my mother who is 87 and my father is deceased, and his name is still on the house. It would depend on how the deed was worded, what other children there are, etc... Absent a will, and assuming any children they had are children of both of them (no other marriages, etc...), then the property will be split among those children at her death.

The cost depends on the value of the property in the estate (especially if it is small enough to meet the small estate threshold).

Not possible to give a real good answer without more details.
