I am a divorced mother of an 11 year old boy. I have "primary custody". His father has visitation and joint decision making for school and religious issues. I have sole decision making on medical issues.
My question is: in writing my will can I appoint a guardian to "take over my part" of the parenting arrangement or will his father automatically get full custody?
If so can I request in my will that a guardian ad litem be appointed in the event of my death to asses whether it would be in my sons best interest to stay exclusively with his father or with my appointed guardian or some combination thereof ?
My ex has mental health issues and is not reliable to consistently raise and guide a child.
He however does not have insight in this regard.
This is why I labored hard to get the parenting arrangement to what it is.
Lastly does it make a difference that I am not a US citizen, rather a legal resident alien w. a green card.?
