Social security taxes on executor fees


What is the name of your state? NY. Executor fees are subject ot federal and state taxes. Are executor's fees subject to social security taxes?

It depends. Generally, executor/trustee fees are income from self-employment and the social security taxes must be paid. However, a person who does the work only in isolated instances for friends or relatives are not always considered to be engaged in a trade or business and social security taxes woud not apply. So, it depends on the facts as to the application of the trust fund taxes.
