state is ohio. my mother and step-father are elderly. they have been married 30 yrs. is there a certain percentage of my step-fathers estate that my mother has a right to.he is leaving her 34 percent. i thought she should have 50 percent.

In Ohio, a surviving spouse can elect to take one-half of the net estate, unless two or more of the decedent's children or their lineal descendants survive, in which case the surviving spouse shall take not to exceed one-third of the net estate.
