DEAR DJPIOV:

Yes, it would be advisable to go ahead and have the will probated, so there will be an official record that the surviving spouse/wife is legal owner of all monies and properties, to make the transition easier after you die (if you want to pass these assets on to other surviving relatives or to whomever you choose), and completing the process of getting title/deed to any homes/land transferred to your name in the probate process. Also, you can never be sure that all debts have been paid--at least if you file for probate, a public notice will be issued in the local paper, and any outstanding creditors will know where to mail the bill for final payment.
