If a trust stipulates that the beneficiaries are the children of the trustor and further states that if a beneficiary predeceases the trustor then the trust shall divide the assets of his or her share to the issue of that beneficiary on a per stipes basis. Based on this information, if one of the beneficiaries of the trust predeceases the trustor and has no children would his or her portion of the trust go to his/her spouse or to the his/her siblings named as beneficiaries? What is the name of your state (only U.S. law)?
