My uncle died in July, 1999 and his wife in November, 2000. As I understand it, he left his estate in a living trust to his wife (TEXAS) with the distribution to heirs after her death. No will has been filed for probate on him but her will has been filed in the probate court.

Is there any way to find out the status of the trust or must the family wait it out in probate court???

DEAR BELLE:

Trusts are private information that is not public record, so your first step will be to ask the executor for information about the trust--whether or not you or your siblings will be beneficiaries, etc. Understand that it may take a few months for the estate affairs to be settled before anyone can say definitively what you will be eligible to receive.

If the executor or trustee is not forthcoming with providing you information, you may need to hire an attorney to get the information you seek.
