How long must property be in a Trust Will for the adult children to inherit? Is there a specific time or suggested?

DEAR LEAH LEO:

There is no such thing as a "TRUST WILL"; either there is a trust, or a will, or both. In order for children to inherit, someone must submit the will to a probate court to be probated. With the trust, you must contact the trustee in order to get information about when he/she plans to distribute the proceeds of the trust to the beneficiaries. There is no specific time--if the beneficiaries don't act, then they are making a mistake by leaving it up to someone else to get things going.

SINCERELY,

advisor
