California One of my Uncles is executor of family trust, as well as a named beneficiary. The manner in which he has administered the trust so far has found its way into the courts, as more than a few beneficiaries feel some degree of oversight seems neccesary because most of his decisions and activities lend themselves towards oppurtunistic motives. The executor and his council keep postponing the court date. The executor has decided to replace the real estate broker who has had my deceased Grandparents home listed for about a year now. Uncle has decided to sell the home himself and has stated his intention to award himself a sales commision as if he were the real estate agent or broker, as well as compensate himself for his fidiciuary efforts as an executor. Within 24 hours of recieving this news, he brought to the attention to some of the beneficiaries that he had solicited a buyer, and on top of having already dropped the asking price by more than 5% below fair market value he had arranged a deal with this prospective buyer to further drop the asking price by $50,0000 with an agreement that the buyer, who is a profesional contractor, would in return perform $50,000 dollars worth of remodeling on the executors private residence at a later date. Is this all legal?
