Trusts and WillsWhat is the name of your state (only U.S. law)? California We have a trust in place. If either my husband or I die will the trust still be valid or will the surviving spouse have to get the trust changed? We also have our wills in order. What is the name of your state (only U.S. law)? |

| Normally the trust will still be valid. You should refer to the trust itself for your answer. It should be explained in the trust who the trustee would be if either of you should die, or if you would die simultaneously. The remaining of either of you (second to die) in many cases (depending on the trust) can change the trust, or eliminate the trust. Last edited by curb1; 10-22-2009 at 11:57 AM. |
