U.S. Citizen murdered in Mexico, left no Will..

My father was murdered in Mexico recently (July 2011). We know the wife has the rights since she is the surviving spouse. We were informed he has no living will in the state of Texas. We want his body back in the U.S. but the wife and other children decided that as soon as the DNA results come back proving its my dad they will bury him in Mexico. Can they do that since he is a U.S. citizen in the state of Texas. They havent reported him being dead in the U.S.

If you are willing to accept cremation, this should not be a big deal. She only needs to go there, provide evidence of who she is and things should be put into motion. Laws are more flexible in Mexico, when you first ask how much money you need to give them, to solve the problem. Pretending ignorance of Spanish is helpful also. Getting a body across the border is much more complicated. Mexico will provide the US Consulate with death notification and they will issue a death certificate.
