What is the name of your state?Massachusetts. Dad passed away suddenly leaving a will to Mom, real estate worth 3-7 mil., and an unfunded trust that might have avoided probate and estate tax. Is there anything we can do immediately to pour over assets into the trust while Mom's still with us to protect future beneficiaries?

You need to be talking with a very good attorney who knows about trusts, taxes, and estate planning.

But I have to tell you, an unfunded trust is not worth the paper it is written on.
