What is the name of your state (only U.S. law)? Texas

If the Executor/Trustee resigns from their position and the trust does not need to be probated, how is everything in the trust handed out and those included in the trust get what is left to them?:confused:

Almost always, there is a successor trustee listed in the trust.

If there isn't, often there is this language in a trust: "If there shall be no trustee of a trust, a majority interest of those income beneficiaries who are of legal age and capacity and the guardians, if any, of those who are not of legal age and capacity may by a written instrument appoint a successor trustee or trustees."

And if reading the successor provisions of the trust finds no successor, or with the will, it will take a court action to determine a new one.
