Is it in the penal code as a violation of the law? I have a simiular problem. My uncle has demita and someone has taken advantage of this and had there name put on the property deed as 29% owner.

It really depends on the state. But even if Elder Abuse is not a specific crime, most general larceny and anti-fraud laws should cover it more or less.
