What is the name of your state? GEORGIA

my mom in law passed last week. leaving an estste after expenses of around $35,000

she had a valid indiana will - no will in georgia- she lived as a legal resident of georgia for the past 3 years.

is the indy will valid in georgia? do we need to go to probate court to execute the will ( if it is still legal in georgia)

or is the small amount of the estate less then $50,000 - not require probate-

or - can we just divide funds as per her final will?

Call the county courthouse to find out what the minimum amount of estate value is in that Georgia county before probate is required.

The Indiana will most likely will not be valid in Georgia--you need to be consulting with a local Georgia probate attorney about this since it is not very likely that a Georgia probate attorney will be reading this message board.
